Submitting a DMCA Takedown Notice

Required Elements for a Takedown Notice:

Counter-Notification Process

If your content was removed due to a DMCA takedown notice, you have the right to submit a counter-notification. This allows you to dispute the claim of infringement. We will reinstate the material if a proper counter-notification is received.

Required Elements for a Counter-Notification:

A physical or electronic signature of the subscriber.
Identification of the material that has been removed or to which access has been disabled, and the location where the material appeared before it was removed or disabled. A URL link is required.
A statement under penalty of perjury that the subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
The subscriber’s name, address, and telephone number.
A statement that the subscriber consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if the subscriber’s address is outside of the United States, for any judicial district in which Luxury Dubai may be found. The subscriber must also agree to accept service of process from the person who provided the original DMCA notification or an agent of such person.

Once a valid counter-notification is received, we will forward a copy to the original complaining party. We will typically restore the removed material within 10 to 14 business days, unless the copyright owner files a court action seeking a court order to restrain the subscriber from engaging in infringing activity.

Repeat Infringer Policy

Luxury Dubai maintains a policy of terminating account access for users who are repeat copyright infringers. We will terminate the access of users who repeatedly or flagrantly infringe the copyrights or other intellectual property rights of others. This applies to content such as property listings, images, or articles.
